Terms of Service

These terms are an agreement between you and Lionel Castro (“we”, “us”) and cover your use of the FMA Soul mobile app and this website (the “Service”). By using the Service you agree to them, and to our Privacy Policy. If you don’t agree, please don’t use the Service.

1. Who can use the Service

You must be at least 13 years old to create an account. If you’re under the age of majority where you live, a parent or guardian must agree to these terms for you and supervise your training.

2. Physical training risk: please read

• You assume all risk of injury to yourself, to anyone training with you, and to bystanders, as well as all risk of property damage, from your participation.
• See a physician before starting any new exercise program, especially if you have a medical condition, an injury, or are pregnant.
• Stop immediately if you feel pain, dizziness, or discomfort.
• Train safely: clear the space around you, use training (not live) weapons, wear protective gear where appropriate, and never train with a partner beyond what both of you can safely control.
• The Service is instructional content, not personal coaching, medical advice, or a substitute for a qualified in-person instructor.

To the fullest extent the law allows, you release Lionel Castro from claims arising from your training, except where the harm was caused by our gross negligence or willful misconduct.

3. Your account

You sign in with Apple, Google, or Microsoft. You’re responsible for what happens under your account, so keep that sign-in secure. Tell us at support@fmasoul.com if you think someone else is using your account. You can delete your account at any time. See how to delete your account.

4. Free and paid access

Foundation drills are free, with or without an account. A paid membership unlocks more content and higher limits. What each level includes may change over time as we add, revise, or retire content.

5. Membership billing

• Pricing. The minimum membership price depends on the country you choose. You may choose to pay more than the minimum. Prices include a payment processing fee and are charged in US dollars.
• Automatic renewal. Your membership renews automatically at the end of each monthly or yearly period, and your payment method is charged, until you cancel.
• Renewal price. Each renewal charges the higher of the rate you chose and the minimum price for your country at that time. If that minimum goes up, your renewal price may go up with it. We’ll notify you before a price increase takes effect.
• Cancelling. You can cancel at any time from your account. Cancelling stops future renewals. You keep access until the end of the period you’ve already paid for.
• Refunds. Payments are non-refundable and we don’t give credit for partly used periods, except where the law requires it. Deleting your account ends your membership immediately, without a refund for the rest of the period.
• Accurate information. The country you pick must be where you live. We may review or end memberships bought with false information.

6. Content and licence

All content in the Service, including training videos, clips, drill sequences, audio, music, drum loops, images, text, and the design of the app and website, belongs to us or our licensors and is protected by copyright and other laws. We give you a personal, non-exclusive, non-transferable, revocable licence to use it for your own training only.

Without our prior written permission, you may not copy, record, download outside the app, redistribute, resell, broadcast, publicly perform, or use the content to teach classes or make other products, and you may not share your account or access with others. Drills you download work only inside the app. The FMA Soul name and logo are ours, and you may not use them without our permission. To ask for permission, email support@fmasoul.com.

7. Acceptable use

Don’t:

• get into, or try to get into, any account, server, database, or API you’re not allowed to use;
• get around access controls, paid-content locks, or download limits, or scrape or bulk-download content;
• probe, scan, or test the Service for security holes, or exploit any you find (if you find one, please tell us at support@fmasoul.com instead);
• copy, change, decompile, or reverse-engineer the app, or make or use modified or cracked versions of it, except where the law expressly allows this;
• use bots, scripts, or other automated tools to access the Service;
• upload or spread viruses, malware, or other harmful code;
• interfere with, disrupt, or overload the Service;
• use the Service unlawfully, or to harm anyone.

8. Ending access

You can stop using the Service and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms. Where we reasonably can, we will tell you why first. If we end a paid membership for a reason other than your breach, we’ll refund the unused part of your period.

9. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties, express or implied, including fitness for a particular purpose. We don’t promise the Service will be uninterrupted or error-free, or that any particular training result will follow.

10. Limitation of liability

To the fullest extent the law allows, we won’t be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50. Some places don’t allow these limits, and nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by our negligence where that exclusion is prohibited.

11. Indemnity

If you misuse the Service or break these terms, you agree to cover any claims, losses, and reasonable legal costs that result. This includes claims by people you train with.

12. App stores

If you downloaded the app from the Apple App Store or Google Play, these terms are between you and us, not Apple or Google. Apple and Google are not responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the app’s purchase price (if any). Beyond that, Apple has no warranty obligation for the app.

13. Changes

We may update these terms. If a change is significant, we’ll ask you to accept it the next time you open the app or the website. If you don’t accept, you can stop using the Service and cancel.

14. Governing law

These terms are governed by the laws of the State of California, USA, except where the law of the country you live in gives you rights that can’t be waived.
